DMCA Policy

At Custom4U, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented the following policy to address claims of copyright infringement on our website.

Reporting Copyright Infringement

Counter-Notification

If you believe that the material removed or to which access was disabled is not infringing, or that you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to law, to post and use the material, you may send a counter-notification to our DMCA Agent. A counter-notification must include:

  • Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in [Your Jurisdiction], and that you will accept service of process from the person who provided the original notification of the alleged infringement.
  • Your electronic or physical signature.

If a counter-notification is received, we may send a copy of the counter-notification to the original complaining party, informing them that we may restore the removed material in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be restored on our website in 10 to 14 business days after receipt of the counter-notification.

Repeat Infringers

In accordance with the DMCA and other applicable law, we may terminate user accounts that are deemed to be repeat infringers. We also reserve the right to limit access to our services and/or terminate the accounts of users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.
